MARELCO™ IS A TRADEMARKED BRAND NAME INVENTED, DESIGNED AND MANUFACTURED BY EMCS INDUSTRIES LTD (EMCS).
ALL MARELCO™ PRODUCT INSTALLATIONS REQUIRE SUPERVISION AND Commissioning TO BE COMPLETED BY AN AUTHORIZED EMCS TECHNICIAN UNLESS EXPRESSLY WAIVED IN WRITING BY EMCS EXECUTIVE.
ANY PRODUCT OR WORK UNDERTAKEN BY A THIRD PARTY IS NOT COVERED BY THE WARRANTY. THE Commissioning OF THE MARELCO PRODUCTS SUPPLIED BY EMCS AND COMMISSIONED BY EMCS TECHNICIANS WILL RESULT IN THE FOLLOWING WARRANTY OF THE SYSTEM:
WARRANTY
1. The lifetime warranty covers the period from the installation of the MARELCO™ supplied product for the duration of the design life of the anodes.
2. During the warranty period, and subject as otherwise set out herein, EMCS Industries warrants only the work manufactured and delivered by EMCS and its certified technicians.
3. Without assuming liability, and to the extent permitted by the applicable manufacturer, EMCS will endeavor to provide to the customer any warranty for products not manufactured by EMCS.
4. In case of a claim, the customer will notify EMCS in writing, with appropriate documentation, during the warranty period. All claims hereunder must be received by EMCS during the warranty period.
5. If the work is defective, as determined by EMCS, EMCS’s total responsibility will be limited to correction at EMCS’s plan of defective work. EMCS will not assume any expense or liability for correction of defective work carried out by the customer or any third party without the prior written authorization of EMCS. The customer will bear all shipping costs associated with a claim.
6. This warranty will be void if product is not commissioned by an EMCS authorized technician or if during the warranty period the product has been improperly used, installed, maintained, operated under abnormal conditions or contrary to applicable specifications, or fails because of normal wear and tear. In no event will EMCS be liable to the customer or any third party for any of the following:
a) Materials (unless EMCS supplies defective materials or work is defective due to design), special, incidental, consequential, indirect, or punitive damages (other than for bodily injury, including death,caused by EMCS’s negligence). This includes, but is not limited to, lost profits, revenues or savings, curtailment or interruption of plant operation, strike, pollution or the removal, disassembly and/or reinstallation of work, even if EMCS is informed of the possibility of such damages.
b) Third party claims against the customer for damages other than damages for bodily injury, including death, caused by the EMCS’s negligence; modified work completed by any party other than EMCS.
7. APART FROM THE EXPRESS WARRANTY HEREIN, EMCS DISCLAIMS ALL OTHER EXPRESS OR IMPLIED CONDITIONS OR WARRANTIES.
DECLINING MARELCO SUPERVISION AND/OR COMMISSIONING
The lifetime warranty is not valid if the EMCS Technician does not complete commissioning, and the customer will assume all losses or damages to the system or components if not completed correctly by user.
